Please familiarize yourself with our Terms of Use and Listing Policies prior to use and/or enter a property listing on Shopperty. All listings are subject to the Listing Policies.

Agreement between you and Shopperty Real Estate

The Shopperty website is comprised of various web pages operated by Shopperty Real Estate.

Shopperty is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use Shopperty constitutes your agreement to all such terms, conditions, and notices.

Modification of Terms of Use

Shopperty reserves the right to change the terms, conditions, and notices under which the Shopperty website is offered, including but not limited to the charges associated with the use of the website.

Links to third party websites

Shopperty may contain links to other websites (Linked Sites). The Linked Sites are not under the control of Shopperty and Shopperty is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Shopperty is not responsible for webcasting or any other form of transmission received from any Linked Site. Shopperty is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Shopperty of the site, its products, or any association with its operators.

Listing review

All listings entered on Shopperty may be subject to review. Shopperty reserves the right, to review, modify, and/or remove any listing entered on Shopperty.

You, as the listing’s owner, remain solely responsible for abiding by the Listing Policies and Shopperty Terms and Conditions. The Listing Policies prohibit you from entering any listing that infringes upon the intellectual property rights of any party, or that otherwise violates Shopperty Terms and Conditions. By entering listings on Shopperty, you warrant and represents that you owns or otherwise controls all of the rights to such content including, without limitation, all the rights necessary for you to provide, post, upload, input or submit such content. You acknowledge that Shopperty cannot police or control all of the content that is made available on its website.

Listings that violate any of the Listing Policies stated herein will be removed from the website. New listings added to Shopperty are examined to determine whether such listings are in compliance with the Listing Policies. In the event we determine that a listing violates Listing Policies (including but not limited to containing inaccurate or incomplete information), you will be notified by email and will be given a reasonable amount of time (routinely, 48 hours) to respond. It is then your sole responsibility to revise the listing as appropriate, and resubmit with the corrected information and/or photos. If you fail to respond to the communication from Shopperty, Shopperty in its sole discretion reserves the right to remove any and all content and/or user that continues to violate the Listing Policies.

Required fields

All fields noted by an asterisk (*) on the add property page are required fields and must be completed with valid data pertaining to the property being listed (Required Fields). Property listings where data is missing or data entered in the Required Fields is deemed illogical will be removed from the site until valid content is entered in the Required Fields.

Address fields

All Address fields on Shopperty website including Address, Province, State, District, Region, ZIP code, and any other field designated for such purpose are Required Fields. These fields are intended for listing the physical address of the property being listed. These fields are not for the listing of additional information about the property (see Property Description). Entering Confidential, Call Broker, Withheld, or any other verbiage designed to withhold, hide, and/or conceal the physical address in the Address field is strictly prohibited. Shopperty reserves the right to remove any and all property listings with non-address related or invalid information in any address specific field with or without contacting the listing’s owner.

Property description

Property descriptions are for the description of the property only. The posting of contact name, phone number, fax number, company information or URL links for any contacts is strictly prohibited in this section. This type of information in the Property Description field will cause the listing to be removed from the website.

Property type

Properties must be identified with the appropriate property type. Adding the same listings under multiple property types is prohibited (see Duplicates).

Shopperty reserves the right to change or remove listings when their property types deemed to be misleading.

Price

A valid Sales Price in the Price field for the listed property is required for all Shopperty Sales Listings and a valid rental rate for each space is required for all Shopperty Lease Listings. By entering a valid Price in the required field and utilizing this function, properties will return in price range searches. Shopperty reserves the right to remove all listings that are deemed to have invalid prices or rental rates including any listing with $0 listed in Sales Price field. All prices must be in USD American Dollars.

Duplicates

Shopperty prohibits the listing of a single property more than once on the website at the same time. A duplicate is defined as the same physical property listed under more than one property ID. Office, condos, and land parcels with the same physical address are exempt as long as a unit number is included in the address field and/or description fields. Shopperty reserves the right to remove any and all properties that are determined to be duplicates with or without contacting the listing broker. You may, however, list a property for sale and for rent at the same time.

Space listings

Shopperty prohibits the listing of the same space more than once on the web site at the same time. A space listing is defined as a single suite or unit of space listed for lease. Total space available in a building cannot exceed the total square footage of the building. Shopperty reserves the right to combine duplicate space listings into a single listing or to remove the listing from the system with or without contacting the listing’s owner.

Use of photographs

Building photographs posted, attached, or affixed to listings must be actual photographs of the building being listed. All such photographs must be either (a) property of the listing’s owner or (b) the listing’s owner must have received all necessary rights and authorizations, including from the photographer and/or copyright owner of any photographs, to publish such photographs on Shopperty for the purpose of advertising the subject property. Photographs uploaded that are not directly related to the building or property being listed may be removed at the discretion of Shopperty.

For a better handling and display it is recommended that images should not exceed 800x600 pixels at a resolution of 72dpi, approximately 350kb.

Prohibited conduct

Members are advised to refrain from engaging in the conduct specified in this section, as it is not permitted on the Shopperty website.

Billboard listings

Listings on Shopperty are for properties that are currently offered for Sale or Lease. It is not permitted to post listings on the website that have already been sold or are no longer on the market, i.e. posting listings on the website for marketing or advertising purposes (Billboard Listings). All new listings for properties already sold or off-market will be removed.

Once a property listed on the website has been sold, you should mark it accordingly on the fields provided for such purpose (uncheck Approved and/or Published fields). After that, properties can remain on the website until manual or automatic removal by website administration.

Keyword manipulation

The properties listed on the Shopperty website will be indexed by Search Engines, such as Google, Bing, and others. Keyword manipulation is unfair to searchers by returning listings that clearly do not meet their criteria. Keywords identified in the property name, property description, location description or property features field that are clearly not relevant to the property being marketed will be removed.

Habitual abuse of this policy by a member may, at the sole discretion of Shopperty, lead to the removal of all of that member active listings from the website.

Profile section

Members can add personal information to their profile. Content rules for this area are the same that apply for listings.

Offensive language

Use of profanity or vulgar language in any section of Shopperty is strictly prohibited. This includes the use of language that is generally considered obscene, profane, sexual, hateful, or racist in nature. Listing or user information that includes profane language will be removed from the website immediately. Members posting such language to the Shopperty website may be subject to disciplinary action, including indefinite suspension of an account, temporary suspension or a formal warning.

Materials provided to Shopperty or posted at any Shopperty website

Shopperty does not claim ownership of the materials you provide to Shopperty (including listings, feedback and suggestions) or post, upload, input or submit to any Shopperty website or its associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting Shopperty, its affiliated companies and necessary sub licensees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.

No compensation will be paid with respect to the use of your Submission, as provided herein. Shopperty is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in Shopperty's sole discretion.

By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. SHOPPERTY AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SHOPPERTY WEBSITE AT ANY TIME.
